1. The Agreement
This agreement is a contract between the customer (You) and

b) Alexamo Pty Ltd t/as Absinthesalon
Retailer of non alcoholic products & wholesaler of alcoholic products

c) hereafter referred collectively as www.absinthesalon.com.au
By purchasing products and using the www.absinthesalon.com.au service, you acknowledge that you have read and understood these Terms and Conditions and agree to be bound by them.
The entire agreement between You and www.absinthesalon.com.au for the purchase of goods by you from www.absinthesalon.com.au consists of:
a) these Conditions; and b) the Order
An agreement exists between you and www.absinthesalon.com.au once www.absinthesalon.com.au receives and accepts an order at its licensed premises. No obligation to sell or supply goods will arise until the order is received at the licensed premises.
Each order is a separate agreement.
2. Placing and purchasing of orders
a) You place an order and purchase goods on www.absinthesalon.com. au by selecting products on the website and proceeding through to the checkout where you will be redirected to the secure payment gateway to enter your credit card details. After completion of your payment details you will be asked to click the Continue button to confirm your order. In doing so the ordering process is complete.
b) It is a requirement of this website and by law, that you must be 18 years or over to place orders for and/or purchase alcohol.
c) It is an offence to sell or supply to or to obtain liquor on behalf of a person under the age of 18 years.
d) For this reason, before you make a liquor purchase on this website, you will be asked to supply your date, month and year of birth and confirm that you have read and understood the terms and conditions. You will not be able to go further with your order until you have complied with this request. If you are purchasing absinthe for a gift then the person receiving the gift should also be over 18 years. Obviously you do not have to be over 18 years to purchase accessories but we kindly ask you to also enter your details to make the ordering process run smoothly.
e) The payment service being utilised by this website is Paymate. Paymate is a secure, accurate and reliable internet payment service based onshore in Australia. For your information you may find out more about the company and its trusted reputation at www.paymate.com.au
g) Purchases of absinthe and accessories from this website can be made by Visa or Mastercard via Paymate or by EFT (direct deposit).
h) If you wish to purchase accessories only and you do not have a credit card then feel free to contact us to make alternative payment arrangements, for example cheque or money order.
i) All products featured on this website are only available for sale and delivery within Australia.
j) All absinthe available for sale on this website has complied with Australian legislation in regard to permits for importation and all customs duties and taxes have been paid.
k) www.absinthesalon.com.au supports the responsible service of alcohol.
3. Delivery of goods
a) Orders are dispatched both registered and insured by Australia Post (all absinthe over 70% alc./vol. is delivered by courier) and upon receipt require the signature of the person named in the shipping/delivery address who must also be over 18 years of age.
b) Accessory orders over the value of $50 will be dispatched in the same manner and a signature also required. Accessory orders under the value of $50 will be dispatched by normal parcel post.
c) Goods will either be delivered to the address in the delivery instructions or if there is no one available to accept the delivery a card is placed in the mail box for the recipient to collect the goods from the post office or redelivered by courier.
d) Quoted delivery time frames for registered parcels via Australia Post from lodgement zone in Sydney to destination zone are as follows:
1 business day - within in Sydney metro area,
2 business days - between Sydney and metro areas of east coast capitals including Adelaide,
3-5 business dayes - between Sydney and metro areas of other capital cities,
1-3 business days - between Sydney and NSW country location,
4-6 business days - between Sydney and interstate country locations. (Courier delivery times are similar to above.)
e) Please allow an extra day for processing payment, packing and dispatching of order.
f) www.absinthesalon.com.au takes no responsibility for delays incurred by Australia Post or the courier system.
g) If you are concerned about your delivery, please contact us with your details and we will track the parcel for you through the registered post tracking system or our courier tracking system.
h) All goods are securely packaged against breakage in transit.
i) Under no circumstances will deliveries be made to post boxes.
j) You will not be charged a delivery fee.
4. Risk and title
a) Risk and title in the goods in each order passes onto you upon receipted delivery of the goods to the delivery address.
b) You will inspect the goods immediately upon delivery to you or upon collection of that order by you.
c) If at any time you are not satisfied with the quality of goods you have purchased, you may contact www.absinthesalon.com.au and we will assess your situation.
d) This contact must be made by you within 2 weeks of accepting delivery of the goods.
5. Price of goods
a) The price you shall pay for the goods shall be the price specified on the website.
b) The prices specified on the website are inclusive of GST.
c) Prices may be subject to variation without notice. The price payable for the goods shall be the price applicable on the date the goods are confirmed as ordered. d) Paymate adds a small transaction fee to the purchase. Please check their website for details.
6. Out of stocks and substitutions
a) At times you may notice that a product is out of stock. This is only temporary and will usually be due to high demand and/or awaiting next shipment.
b) When products are available or out of stock they will be indicated so on the individual product page.
c) At times new products which we know will be under high demand are indicated as pre-order items. These are treated as normal purchases. Please note that if you go ahead with the transaction on a pre-order product your credit card WILL be debited or an EFT WILL be required to secure your order. The availability date for pre-orders is stated on product page.
d) We will not take the liberty of substituting a product for another that has been ordered by you.
e) In the event that a product purchased by You is does happen to be out of stock due to multiple orders being processed at the same time for that product we will immediately contact you and refund you the appropriate amount.
7. Packaging and labelling of goods
a) All product images on www.absinthesalon.com.au are up to date.
b) Because some non alcoholic products on www.absinthesalon.com.au are handmade, such as the water fountains, there may be slight variations from the image portrayed.
c) All alcoholic products are labelled with the approximate number of standard drinks per bottle. We advise our customers on how to drink absinthe responsibly on our FAQs page.
8. Licence
You are licensed to use the www.absinthesalon.com.au website on your computer for your use in purchasing goods from www.absinthesalon.com.au. You acknowledge that you are not permitted to make any other use of the www.absinthesalon.com.au website unless given prior written authorisation by the website owners.
9. Intellectual property rights
a) You acknowledge that www.absinthesalon.com.au and its related companies own or are licensed to use all Intellectual Property Rights in www.absinthesalon.com.au (including, but not limited to, any images, photographs or text, which appears on the site). You agree that you will make no representation to the contrary, and that you must not use or copy www.absinthesalon.com.au in any manner that is inconsistent with the rights of the owner or licensee of such Intellectual Property Rights.
b) You acknowledge that any trademarks or logos which appear on the www.absinthesalon.com.au website are owned by or licensed to www.absinthesalon.com.au or its related corporations, and that you must not do anything to prejudice the rights of the trademark owner or licensee to such trademarks or logos.
10. Liabilty
a) You acknowledge that the www.absinthesalon.com.au service is provided "AS IS" and that www.absinthesalon.com.au is not making and has not made any warranty or representation as to the suitability of goods for any particular purpose.
b) You agree that any liability of www.absinthesalon.com.au arising out of or in connection with any breach of any express or implied warranty or condition in respect of goods or services supplied to you through use of www.absinthesalon.com.au will be limited to, the replacement of the goods or the supply of equivalent goods.
c) You agree that the entire risk arising out of installation, down loading, use or performance of www.absinthesalon.com.au remains with you. To the extent permitted by law, you release and discharge www.absinthesalon.com.au and its related corporations from all forms of direct, special, indirect or consequential loss or damage (including loss of profits, loss of data or loss or damage that may reasonably have been supposed to have been in the contemplation of the parties as at the date of this Agreement) arising out of or in connection with www.absinthesalon.com.au or this Agreement, including, without limitation, loss or damage caused by the negligence of www.absinthesalon.com.au or its related corporations.
11. Security
You agree to take responsibility for the safekeeping of your credit details and pin codes. You are liable if any unauthorized persons use your Credit Card and passcodes. You agree to release and indemnify www.absinthesalon.com.au in relation to any liability arising out of the unauthorized use of your credit card and passcodes.
12. Notification of changes
www.absinthesalon.com.au may add to, delete, or otherwise change any of the terms of this Agreement. Your use of the www.absinthesalon.com.au services will be bound by the Terms and Conditions, prices and other information present on the day of your use.
13. Privacy Policy
a) The personal information collected from you by www.absinthesalon.com.au is purely for the purposes of fulfilling our services to you in regard to your purchase. This information primarily consists of contact details, name and address of purchaser and recipient and date of birth details.
b) www.absinthesalon.com.au does not disclose your information to third parties other than the recipients address in order for the goods to be delivered or when it is necessary to comply with law or to protect the rights and property of www.absinthesalon.com.au
c) All credit card details are not collected by www.absinthesalon.com.au but by the secure server of Paymate. You may link to www.paymate.com.au to view their Privacy Policy.
d) A cookie is a small data file that contains information about your visit to our website. Your computer provides this information during your first visit to our web server. The server records this information in a text file and stores this file on your hard drive. When you visit our website again, the server looks for the cookie and structures itself based on the information provided. We use cookies to help us improve our service to you and to ensure our site is easy to navigate.
14. Termination
www.absinthesalon.com.au may terminate this Agreement at any time by delivering notice or by sending you a system message (email notification) advising that your shopping privileges have been removed. If this occurs, please contact enquiries@absinthesalon.com.au. Termination of this Agreement shall be effective the day the notice is received and recorded or on a later date as specified in the notice.

www.absinthesalon.com.au may send any notices to you by email or by regular mail to your addresses contained in the information given by you when you purchase from the website.
